Islamabad to Establish Special Courts for Overseas Pakistanis’ Property Disputes

ISLAMABAD: In a landmark move to address property disputes faced by overseas Pakistanis, the Islamabad High Court (IHC) has directed the establishment of special courts under the Overseas Property Act 2024 to ensure swift and transparent resolution of such cases.

Acting Chief Justice of the Islamabad High Court has instructed the designation of special courts exclusively for overseas Pakistanis’ property-related disputes. To expedite the process, he has delegated the authority to nominate judges for these courts to the session judges of Islamabad.

The Registrar of the Islamabad High Court has formally communicated this decision to the Secretary of Law and Justice in an official letter. The letter directs that session judges of East and West Islamabad should nominate judges for the special courts based on pending caseloads and judicial expertise.

Additionally, the Ministry of Law has been requested to issue official notifications for the appointment of session judges under the Overseas Property Act 2024.

In another significant step, the Islamabad High Court has constituted a special bench to oversee appeals and cases related to property disputes involving overseas Pakistanis. Justice Khadim Hussain Soomro has been appointed to hear these cases and appeals. The Deputy Registrar of IHC has issued a formal notification confirming this development with the approval of the Acting Chief Justice.

This initiative is expected to provide relief to overseas Pakistanis, ensuring efficient legal recourse and timely resolution of property disputes, which has been a long-standing issue for expatriates.
